BOOKING TERMS & CONDITIONS

These Terms & Conditions (“Terms”) apply to bookings for retreats operated by [BLUE HOUR TRIPS], ABN/ACN [12667654475], of Queensland, Australia (“Company”, “we”, “us” or “our”).
By submitting a booking, paying a deposit or other amount, or otherwise confirming attendance at a retreat operated by us (“Retreat”), you (“Guest”, “you” or “your”) acknowledge that you have read, understood and agree to these Terms.
1. THE RETREAT
The Retreat is an influencer-led group experience taking place in Byron Bay, New South Wales, Australia.
Your Retreat package may include:
accommodation for the advertised Retreat dates;
meals specified in the Retreat itinerary;
scheduled group activities;
wellness and recreational activities;
workshops, presentations and Q&A sessions;
access to the Retreat’s designated host(s) or influencer(s);
use of designated venue facilities; and
any additional inclusions expressly stated on the booking page.
Exact inclusions may vary between Retreats and will be specified on the applicable booking page or itinerary.
Unless expressly stated otherwise, your booking does not include:
flights;
transportation to or from Byron Bay or the Retreat venue;
travel insurance;
personal expenses;
meals or beverages not specified in the itinerary;
medical expenses;
additional accommodation outside the Retreat dates; or
activities not expressly included in the Retreat package.
Guests are responsible for arranging and paying for their own transportation to and from the Retreat.
2. ELIGIBILITY
Unless otherwise expressly stated, Guests must be at least 18 years old at the commencement of the Retreat.
We reserve the right to request identification to verify a Guest’s identity and age.
Bookings may not be transferred or resold without our prior written approval.
3. BOOKING AND PAYMENT
The total Retreat price is the amount displayed at the time of booking.
A booking is not confirmed until we have received the required payment and issued confirmation of the booking.
Where a payment plan is offered, all instalments must be paid by the dates specified at checkout.
Failure to make an instalment when due may result in cancellation of the booking after reasonable notice.
The Guest remains responsible for the full amount payable under the booking subject to these Terms and applicable law.
All prices are stated in Australian dollars unless otherwise specified.
4. GUEST CANCELLATIONS
Because Retreats require us to make advance commitments to venues, hosts, caterers, activity providers and other suppliers, cancellation may result in costs that cannot reasonably be recovered.
If you wish to cancel your booking, you must notify us in writing at HELLO@BLUEHOURTRIPS.COM
Subject always to your rights under the Australian Consumer Law, the applicable cancellation policy will be disclosed to you before booking and forms part of these Terms.
Any cancellation fee retained by us will be limited to the amount permitted by applicable law, including reasonable costs or losses incurred in connection with your cancellation.
Where we are able to fill your place with another eligible Guest, we may, at our discretion and subject to reasonable administrative costs and amounts we cannot recover from suppliers, provide an additional refund.
We strongly recommend that Guests obtain comprehensive travel insurance covering cancellation, illness, injury, emergencies and other circumstances that may prevent attendance.
5. FAILURE TO ATTEND
If you fail to attend the Retreat, arrive late, voluntarily leave early, or elect not to participate in an included activity for reasons unrelated to a failure by us to provide the contracted services, you will generally not be entitled to a refund for unused portions of the Retreat, subject to applicable law.
6. COMPANY CANCELLATION OR POSTPONEMENT
We may cancel, postpone or relocate the Retreat where reasonably necessary because of circumstances including:
severe weather;
natural disaster;
government restrictions;
venue closure or unavailability;
serious illness or emergency;
safety concerns;
events outside our reasonable control; or
circumstances making the Retreat unsafe, unlawful or materially impracticable.
If we cancel the Retreat and cannot provide the contracted services, we will provide the remedy required under applicable law.
Where appropriate and legally permitted, we may offer Guests the option of transferring their booking to a rescheduled Retreat or accepting a credit. Nothing in these Terms requires a Guest to accept a credit where the Guest is legally entitled to a refund.
We are not responsible for separately booked flights, transport, accommodation or other travel arrangements except to the extent liability cannot lawfully be excluded.
Guests should therefore purchase appropriate travel insurance and, where possible, refundable or flexible travel arrangements.
7. HOST OR INFLUENCER CHANGES
The Retreat may be marketed in association with one or more influencers, creators, speakers, facilitators or hosts (“Host”).
We understand that the identity of the Host may be an important reason Guests choose to attend.
If a Host becomes unable to attend because of illness, emergency, circumstances outside our reasonable control or another legitimate reason, we will make reasonable efforts to provide an appropriate alternative arrangement.
Depending on the circumstances, this may include a replacement host, modified programming, postponement, credit, partial refund or refund.
Your rights in these circumstances will depend on the nature and significance of the change and your rights under applicable law.
Nothing in these Terms limits any remedy available to you where the absence or substitution of the advertised Host constitutes a major failure or otherwise gives rise to a remedy under the Australian Consumer Law.
8. ITINERARY CHANGES
Retreat itineraries are provided as a reasonable indication of planned activities.
We may make reasonable changes to activity times, meals, instructors, speakers, suppliers or scheduling where necessary.
Where an advertised inclusion becomes unavailable, we may substitute an inclusion of reasonably comparable nature or value where appropriate.
We will not make changes that materially alter the fundamental nature of the Retreat without addressing any rights Guests may have under applicable law.
9. ACCOMMODATION
Accommodation is provided according to the room or occupancy arrangement selected or advertised at the time of booking.
Where accommodation is based on double, twin, triple or quadruple occupancy, you acknowledge that you may be sharing accommodation with other Guests.
We cannot guarantee compatibility between Guests sharing accommodation.
Guests must comply with reasonable venue rules and must not intentionally or negligently damage the venue or its contents.
Guests may be responsible for the reasonable cost of repairing damage caused by their deliberate, reckless or negligent conduct.
10. MEALS, DIETARY REQUIREMENTS AND ALLERGIES
Meals included in the Retreat will be described in the applicable itinerary.
Guests must notify us of known allergies and dietary requirements by the deadline specified before the Retreat.
We will make reasonable efforts to accommodate disclosed dietary requirements but cannot guarantee that an environment will be completely free from particular allergens.
Guests with serious or life-threatening allergies are responsible for carrying any medication prescribed to them and should contact us before booking to discuss whether their requirements can reasonably and safely be accommodated.
11. HEALTH AND PARTICIPATION
Retreat activities may include yoga, swimming, sauna use, cold-water or ice-bath exposure, exercise, walking and other physical or recreational activities.
Participation in individual activities is voluntary unless expressly stated otherwise.
You are responsible for deciding whether an activity is appropriate for you.
You agree to disclose to the relevant qualified activity provider any information reasonably necessary for your safe participation.
Nothing provided during the Retreat constitutes individual medical diagnosis or treatment.
Statements made by Hosts or other Guests concerning health, wellness, nutrition or lifestyle may reflect personal experiences or opinions and should not be treated as personalised medical advice.
12. ACKNOWLEDGMENT OF RISK
You acknowledge that participation in travel, physical activity and recreational activities involves inherent risks.
Depending on the activity, risks may include slips and falls, physical exertion, heat exposure, cold exposure, swimming-related risks, dehydration, allergic reactions, injury and other risks ordinarily associated with the relevant activity.
You agree to follow reasonable safety instructions provided by us, the venue and activity providers.
You must not participate in an activity where you reasonably believe doing so would create an unacceptable risk to your health or safety.
13. EMERGENCY MEDICAL ASSISTANCE
If you become ill or injured and are unable to make decisions for yourself, you authorise us to contact emergency services and take reasonable steps to obtain assistance for you.
You remain responsible for your own medical, ambulance, hospital and related expenses except where those costs arise from circumstances for which we are legally responsible.
14. THIRD-PARTY PROVIDERS
Certain components of the Retreat may be provided by independent third parties, including accommodation providers, chefs, caterers, yoga instructors, photographers, transport providers and other activity providers.
Those providers may have their own reasonable safety rules and participation requirements.
Nothing in this section excludes or restricts any liability we have under applicable law for services supplied to you as part of the Retreat package.
15. GUEST CONDUCT
We want the Retreat to provide a safe and respectful environment for everyone.
Guests must not engage in:
harassment;
bullying;
threatening or abusive behaviour;
unlawful conduct;
deliberate damage to property;
dangerous behavior;
serious disruption of the Retreat; or
conduct that reasonably threatens the safety or wellbeing of another person.
Where reasonably necessary for safety or the wellbeing of other attendees, we may require a Guest to cease particular conduct or, in serious circumstances, leave the Retreat.
Any decision to remove a Guest will be made reasonably having regard to the circumstances.
A Guest removed because of their serious misconduct may not be entitled to a refund, subject to applicable law.
16. ALCOHOL AND OTHER SUBSTANCES
Where alcohol is available, Guests must consume it responsibly.
Guests must not participate in activities where intoxication would make participation unsafe.
Illegal drugs are prohibited at the Retreat.
We reserve the right to restrict participation in an activity where we or the relevant activity provider reasonably believe a Guest’s condition makes participation unsafe.
17. PERSONAL PROPERTY
Guests are responsible for securing their personal belongings.
To the extent permitted by law, we are not responsible for loss, theft or damage to personal belongings unless caused by our failure to exercise reasonable care or otherwise where liability cannot lawfully be excluded.
18. PHOTOGRAPHY AND CONTENT
Photography and video recording may occur during the Retreat.
We may request permission to use identifiable photographs or video of Guests for promotional, social media or marketing purposes.
Where separate consent is required, Guests will be given an appropriate opportunity to provide or decline that consent.
Guests must respect reasonable requests from other Guests who do not wish to be photographed or recorded.
Commercial filming, recording or use of another Guest’s likeness without appropriate permission is prohibited.
19. PERSONAL INFORMATION
We may collect personal information reasonably necessary to:
process bookings;
communicate with Guests;
organise accommodation and activities;
accommodate disclosed dietary requirements;
manage safety and emergencies; and
administer the Retreat.
We will handle personal information in accordance with applicable privacy laws and our Privacy Policy.
Sensitive information will only be collected and used where reasonably necessary and permitted by law.
20. TRAVEL INSURANCE
We strongly recommend that all Guests purchase comprehensive travel insurance as soon as their booking is confirmed.
Appropriate insurance may include cover for:
cancellation;
illness or injury;
emergency medical expenses;
lost or damaged belongings;
travel delays; and
other unforeseen circumstances.
The Company’s insurance does not replace a Guest’s personal travel insurance.
21. LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights arising under the Australian Consumer Law.
To the extent permitted by law, we are not responsible for losses resulting solely from:
a Guest’s own acts or omissions;
failure to follow reasonable safety instructions;
undisclosed circumstances affecting participation;
independent travel arrangements not supplied by us; or
events outside our reasonable control,
except to the extent we are legally responsible for that loss.
Any exclusion or limitation relating to recreational activities applies only to the extent permitted by applicable Australian and New South Wales law.
22. AUSTRALIAN CONSUMER LAW
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify those guarantees or any remedy available to you where doing so would be unlawful.
If there is an inconsistency between these Terms and a mandatory right under the Australian Consumer Law, the mandatory right prevails.
23. FORCE MAJEURE
Where circumstances outside our reasonable control materially affect the Retreat, we may make reasonable changes, postpone the Retreat or cancel affected services.
Examples may include natural disasters, floods, fires, severe weather, government restrictions, public-health emergencies, venue destruction or closure and other events outside our reasonable control.
The consequences of such an event, including refunds, credits or rescheduling, will be determined in accordance with these Terms, our contractual obligations and applicable law.
24. COMPLAINTS
If you experience a problem during the Retreat, please notify us as soon as reasonably practicable so that we have an opportunity to address it.

We will make reasonable efforts to resolve complaints promptly and fairly.
Nothing in this section limits your right to contact an applicable consumer protection body or exercise any legal right.
25. GOVERNING LAW
These Terms are governed by the laws applicable in Australia.
Because the Retreat takes place in New South Wales and the Company is based in Queensland, mandatory laws applicable to either the provision of the Retreat or the parties are not excluded by these Terms.
Any governing-law or jurisdiction provision is subject to rights and protections that cannot lawfully be excluded.
26. CHANGES TO THESE TERMS
The Terms applying to your booking are the Terms presented and agreed to when your booking is made.
We will not retrospectively impose a material change to your booking Terms without your agreement where doing so would be unlawful.
Operational information such as schedules may be reasonably updated in accordance with these Terms.
27. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be read down to the extent permitted by law or, if necessary, severed.
The remaining provisions continue to apply.
28. ENTIRE AGREEMENT
These Terms, together with the applicable booking page, itinerary, payment terms and any other terms expressly incorporated into the booking, constitute the agreement between you and the Company concerning your Retreat booking.
29. ACCEPTANCE
By completing your booking, you confirm that:
you have read and understood these Terms;
you agree to the applicable payment and cancellation conditions;
you understand what is and is not included in the Retreat;
you understand that participation in physical and recreational activities carries inherent risks;
you are responsible for arranging your own transportation to and from the Retreat unless otherwise stated; and
you agree to comply with reasonable safety and conduct requirements during the Retreat.
